BY SUBSCRIBING TO THE HUNBUN SERVICE, USING THE APP OR HUNBUN.CO YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS DO NOT SUBSCRIBE TO THE APP, USE THE SERVICE OR SITE.
Who we are and what these terms cover
Most of the dating apps currently on the market require little time and almost no emotional investment. We're here to shake things up. Hunbun aims to improve online dating by slowing down and humanizing the process. Our mission is to help people create long-lasting and meaningful connections based on emotional intimacy rather than focusing on superficial aspects.
We, Hunbun Limited of 71-75 Shelton Street, London, Greater London, United Kingdom, WC2H 9JQ license you to use:
Hunbun mobile application software (App) and any updates or supplements to it.
The dating service you connect and subscribe to via the App (Service).
The website at hunbun.co (website) and the content we provide to you through it, as permitted in these terms.
Your privacy
Under data protection legislation, we are required to provide you with certain information including who we are, how we process your personal data and for what purposes and your rights in relation to your personal data and how to exercise them. This information is provided in our privacy policy and it is important that you read that information.
Other terms also apply
The way in which you can use the App may also be controlled by the App Store rules and policies and any additional terms of social media platforms which link to or from the App.
Operating system requirements
This App requires an Apple iPhone device (model 6s and above) with iOS operating system version iOS 14 and above.
Support for the App and how to tell us about problems
Support. If you want to learn more about the App or the Service or have any problems using them please take a look at our support resources at hunbun.co.
Contacting us (including with complaints). If you have any issues with the App or the Service, are unhappy with the service you have received or wish to contact us for any other reason please email our customer service team at support@hunbun.co. Further details can be found in our Help Centre on the app.
How we will communicate with you. If we have to contact you we will do so by email or by SMS, using the contact details you have provided to us.
How you may use the App and the Service, including how many devices you may use it on
In return for your agreeing to comply with these terms you may:
Download or stream a copy of the App onto any number of devices and view, use and display the App and the Service on such devices for your personal purposes only.
Receive and use any free supplementary software code or update of the App incorporating "patches" and corrections of errors as we may provide to you;
Use the Service either via our website or the App.
You must be 18
You must be 18 or over to accept these terms and buy the App and use the Service.
You may not transfer the App or your use of the Service to someone else
We are giving you personally the right to use the App and the Service as set out above [LINK TO "HOW YOU MAY USE THE APP"]. You may not otherwise transfer the App or the Service to someone else, whether for money, for anything else or for free. If you sell any device on which the App is installed, you must remove the App from it.
How the Service works
Getting to know you
When you register to use the Service we will ask you a series of questions designed to find out more about you and what you are looking for. This starts with the basics (e.g. your name and date of birth) and where you are located (using location technology) so we can use your location to find matches nearby. We then move on to more in depth questions about your likes, dislikes, beliefs, quirks and your dating history.
We also ask “surface level” and “intimate” prompt questions and “icebreaker” questions which cover everything from your pet peeves to what you value in a relationship, which will be used when you chat with other users to get things moving.
We use this information to create your profile on the App or Service (“Profile”). By providing us with this information you agree that it is truthful and accurate. If you need to update your information you can do so by tapping on the profile button on the App's navigation bar.
You will also take a video selfie to verify your Profile.
We will check the information that you submit to make sure you are who you say you are before your Profile goes live on the App or Service. More information about how we do this can be found at FAQs.
The App and the Service are only currently available in the UK.
Once your Profile has been reviewed by us and approved it will be made available on the App so that other users can view it and your free membership will start. Only part of your Profile will initially be available to other users.
Finding your matches
We will suggest up to 10 potential matches each day while you have an active subscription to the App or Service based on your Profile.
You can interact with other users by interacting with their Profile or answering an icebreaker question.
You will get a feed of everyone who likes or interacts with your Profile.
If you like what you see you can use the “call to action” button to match with someone and start chatting.
Chatting
Once you’ve used the “call to action” button you can chat to someone online.
If you’re lost for words we have a random question generator to help!
The more you chat with someone the more of their Profile you can see (and vice versa). The meter feature in the App or the Service will show you how much of someone’s Profile is unlocked.
To stop people from being ghosted, if you want to un-match you’ll need to give a reason - nothing scary, just select an option from our list, a simple “I’m not feeling the spark” will do.
Once you’ve fully unlocked another user’s Profile you can both decide to plan a date.
Premium Features
Basic membership of the App is free of charge. You will be able to pay to use additional features within the App (Premium Features). You can pay for Premium Features through in-App purchases. If you subscribe to a premium feature using your Apple ID you will need to cancel that Premium Feature using the same method, not through Hunbun or the App.
Before you buy any Premium Features we will provide you with information about what you are buying such as the key features, the price, how long any subscription lasts and how to end your subscription (where relevant). You will be able to buy one off Premium Features or subscribe to Premium Membership for a specific length of time.
If you buy any Premium Features you will have 14 days from the date of purchase (Cooling Off Period) to change your mind and receive a refund. If you use the Premium Feature(s) during the Cooling Off Period you will have to pay for the Premium Feature(s) used up to the point that you cancel. This will be on a pro-rata basis if the Premium Feature is a subscription.
If you purchase Premium Features, you will need to give us the amount of notice specified in the terms for the relevant Premium Feature to cancel after the Cooling Off Period. If you do not give the correct amount of notice you will not receive a refund for any unused period.
EShop Purchases
We may sell products on our website from time to time in our online shop (EShop). This section sets out the terms for any purchases that you make from our EShop.
You can find everything you need to know about us, and our products on our website. We also confirm the key information to you in writing after you order [ either by email] OR [in your online account].
We contact you to confirm we've received your order and we accept it when we dispatch or supply the product.
Sometimes we reject orders, for example, because a product is unexpectedly out of stock or because we can't verify your age (where the product is age-restricted) or because the product was mispriced by us. When this happens, we let you know as soon as possible and refund any sums you have paid.
We charge you when [you order OR we accept your order OR we supply your product]
If you buy any products from our EShop you will have a period of 30 days from the date you receive the product(s) to change your mind and receive a refund. To let us know you want to change your mind, contact our Customer Service Team on: 02081543273 or email us at customercare@hunbun.co.
You can't change your mind about an order for:
Products sealed for health protection or hygiene purposes, once these have been unsealed after you receive them;
Sealed audio or sealed video recordings or sealed computer software, once these products are unsealed after you receive them;
Goods that are made to your specifications or are clearly personalised.
You will be responsible for the cost of returning the products to 71-75 Shelton Street, WC2H 9JQ, London, United Kingdom, and must return the products within 14 days of letting us know you wish to return them. For help with returns contact our Customer Service Team on: 02081543273.
If you handle the product in a way which would not be acceptable in-store, we reduce your refund, to compensate us for its reduced value. For example, we reduce your refund if the product's condition is not "as new", price tags have been removed, the packaging is damaged (including if internal packaging has been opened and cannot be properly resealed) or accessories are missing. In respect of card games, the product cannot be returned if the external wrapper has been opened. In some cases, because of the way you have treated the product, no refund may be due.
We refund you within 14 days of receiving the products back from you (or receiving evidence you've sent them to us). We refund you by the method you used for payment. We don't charge a fee for the refund.
If you think there is something wrong with your product, you must contact our Customer Service Team on: 02081543273. We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law. Your legal rights are summarised below. These are subject to certain exceptions.
Summary of your key legal rights for goods
The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:
Up to 30 days: if your goods are faulty, then you can get a refund.
Up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.
Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.
Our Customer Service Team on: 02081543273 will do their best to resolve any problems you have with us or our products as per our Complaints Policy.
Ending your membership
If you no longer want to use the App or the Service please let us know by deleting your account directly on the App or by contacting us at support@hunbun.co, and we will remove your Profile within 24 hours. Separate cancellation terms will apply to any Premium Features.
Changes to these terms
We may need to change these terms to reflect changes in law or best practice or to deal with additional features which we introduce.
We will give you at least 30 days’ notice of any change by sending you an SMS with details of the change or notifying you of a change when you next start the App or log into the Service.
If you do not accept the notified changes you will not be permitted to continue to use the App and the Service and you may cancel your subscription to the App or Service by giving us no less than 14 days’ notice by emailing support@hunbun.co.
Updates to the App and changes to the Service
From time to time we may automatically update the App and change the Service to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively we may ask you to update the App for these reasons.
If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the App and the Services.
If someone else owns the phone or device you are using
If you download or stream the App onto any phone or other device not owned by you, you must have the owner's permission to do so. You will be responsible for complying with these terms, whether or not you own the phone or other device.
We are not responsible for other websites you link to
The App or any Service may contain links to other independent websites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked and approved their content or their privacy policies (if any).
You will need to make your own independent judgement about whether to use any such independent sites, including whether to buy any products or services offered by them.
Licence restrictions
You agree that you will:
Not rent, lease, sub-license, loan, provide, or otherwise make available, the App or the Service in any form, in whole or in part to any person without prior written consent from us;
Not copy the App or Service, except as part of the normal use of the App or where it is necessary for the purpose of back-up or operational security;
Not translate, merge, adapt, vary, alter or modify, the whole or any part of the App, or Service nor permit the App or the Service or any part of them to be combined with, or become incorporated in, any other programs, except as necessary to use the App and the Service on devices as permitted in these terms;
Not disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of the App or the Services nor attempt to do any such things,
Acceptable use restrictions
You must:
Only have one user account for the App or the Service at the same time
Answer all questions during the registration process or at any other time honestly;
Not use the App or any Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the App, any Service or any operating system;
Not misrepresent your identity to other users or impersonate any other person when using the App or any Service;
Not infringe our intellectual property rights or those of any third party in relation to your use of the App or any Service including by the submission of any material (to the extent that such use is not licensed by these terms);
Not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App or any Service;
Not engage in any behaviour towards other users of the App or Service which is intimidating, bullying or otherwise amounts to harassment of any other user and treat other users with respect;
Not use the App or any Service in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
Not collect or harvest any information or data from any Service or our systems or attempt to decipher any transmissions to or from the servers running any Service.
Problems with other users
We are committed to maintaining a positive and respectful Hunbun community, and we do not tolerate any inappropriate content or misconduct whether on or off the App. If something happens that makes you feel unsafe or uncomfortable, please report it. More information about how to report inappropriate content or behaviour can be found on our FAQs.
Intellectual property rights
All intellectual property rights in the App, the Service and the website throughout the world belong to us, or our partners, and the rights in the App, the Service and any content you access on the website are licensed (not sold) to you. You have no intellectual property rights in, or to, the App, the Service or website other than the right to use them in accordance with these terms.
Our responsibility for loss or damage suffered by you
We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms, supplying defective products from our EShopor our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these terms, both we and you knew it might happen.
We are not liable for business loss. We are not responsible for loss that relates to your use of a product purchased from our EShop for the purposes of your trade, business or profession.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.
When we are liable for damage to your property. If defective digital content that we have supplied damages a device or digital content belonging to you, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
Please back-up content and data used with the App. We recommend that you back up any content and data used in connection with the App or the Service, to protect yourself in case of problems with the App or the Service.
Availability of the App and Service We will always do our best to offer you excellent service but we cannot guarantee that the App and Service will always perform without any errors or interruptions.
We are not responsible for events outside our control. If our provision of the Service, the supply of products from our EShop or support for the App or the Service is delayed or prevented by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event but if there is a risk of substantial delay you may contact us to end your contract with us and receive a refund for any Service you have paid for but not received.
We cannot guarantee that you will find any suitable matches While we provide you with matches based on the information that you and other users provide, we cannot guarantee that you will find a suitable match. While we try to check the information that other user’s provide, we are not responsible for information that other users provide.
When we are not liable for failure to provide the App, Service or website.
We only provide the App, Service and website for domestic and private use. You agree not to use the website for any commercial or business purposes. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. In the event we are liable to you; our liability for any damages, costs or otherwise shall not exceed the total subscription or other fees which you have paid to us in the 12 months prior to any such liability arising.
We may end your rights to use the App, Service and website if you break these terms
We may end your rights to use the App, Service and website at any time by contacting you if you have broken these terms in a serious way. If what you have done can be put right we will give you a reasonable opportunity to do so.
If we end your rights to use the App and Service:
You must stop all activities authorised by these terms, including your use of the App and any Service.
You must delete or remove the App from all devices in your possession and immediately destroy all copies of the App which you have and confirm to us that you have done this.
We will remove your profile from the App and the Service may remotely access your devices and remove the App from them and cease providing you with access to the Service.
Use of the Hunbun.co website
We may update and change the website from time to time. The use of the website (but not the App or Service) is free of charge. We do not guarantee that the website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the website for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal. The website is directed to people residing in the UK. We do not represent that content available on or through our site is appropriate for use or available in other locations. By continuing to access the App, Service and/or website, and any related content and services, you agree and represent to us that you are located in the UK.
How you may use material on the website
We are the owner or the licensee of all intellectual property rights in website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. Hunbun’s status (and that of any identified contributors) as the owners of content on our site must always be acknowledged (except where the content is user-generated). You must not use any part of the content on our website for commercial purposes without obtaining a prior written licence from us or our licensors.
No text or data mining, or web scraping
You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the website or any Services provided via, or in relation to, the website. This includes using (or permitting, authorising or attempting the use of):
Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the website or any data, content, information or services accessed via the same.
Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.
The above shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.
The content on our website is provided for general information only. Although we make reasonable efforts to update the information on the website, we make no representations, warranties or guarantees, whether express or implied, that the content on the website is accurate, complete or up to date.
We are not responsible for websites we link to
Where the website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the content of those sites or resources.
We are not responsible for viruses and you must not introduce them
We do not guarantee that the website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.
You must not misuse the website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the website, the server on which our site is stored or any server, computer or database connected to the website. You must not attack the website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the App, Service and website will cease immediately.
Rules about linking to the website
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to the website in any site that is not owned by you. Our website must not be framed on any other site, nor may you create a link to any part of the website other than the home page. We reserve the right to withdraw linking permission without notice.
We may transfer this agreement to someone else
We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
You may not transfer your rights to someone else
You may not transfer your rights or your obligations under these terms to another person.
No rights for third parties
This agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
If a court finds part of this contract illegal, the rest will continue in force
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Even if we delay in enforcing this contract, we can still enforce it later
Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
Which laws apply to this contract and where you may bring legal proceedings
These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
